The Division on Civil Rights (DCR) has recently amended poster regulations and updated posters required by the New Jersey Law Against Discrimination (NJLAD).
Employment and Family and Medical Leave Posters
All municipalities are required to post the new employment poster and the new Family Leave Act poster in a place that is easily accessible to all employees and prospective employees. Municipalities are also required to make a copy of the posters available to each employee on an annual basis by either email delivery, personal delivery, or through an internet or intranet website that is used by employees.
All government agencies are required to display the updated public accommodations poster in a place that is easily accessible to all patrons/customers/constituents and prospective patrons/customers/constituents. A sample letter for business owners has been created by DCR for your utilization.
Public Housing Agency
If your municipality has a local public housing agency, it is required to display one or both of the official DCR housing posters, the sales and rentals housing poster and the property management housing poster, in places easily visible to all current and prospective tenants, purchasers, and residents.
“All persons who are engaged in the management of residential real property, including, but not limited to, landlords, property management companies, and cooperative and condominium associations, shall display the official property management housing poster of the Division in places easily visible to all residents, whether tenants or owners, and all prospective tenants and purchasers.”
In addition, “all real estate brokers and all persons who engage in the business of selling or renting their own or others’ real property shall display the official sales and rentals housing poster of the Division in places easily visible to all prospective tenants and purchasers. Agencies engaged in both the sale and rental of real property and management of residential real property are required to display both posters. A sample letter for sale and rental housing and property management companies has been created by DCR for your utilization.
Health Care Facility
If your municipality runs or owns a health facility, such as a medical testing site or community health center, it is required to display a health facilities-specific poster.
DCR has created six medical facility posters for alternative treatment centers, emergency and trauma facilities, licensed professional facilities, long- and short-term care facilities, mental health facilities, and pre- and post-natal facilities.
The facility-specific poster must be displayed in a place that is easily accessible to all patients or potential patients. This includes a location near each entrance through which the public can enter or exit and all public waiting rooms. Facilities may also choose to display the posters in other locations, including individual treatment rooms or on a digitally accessible platform code, such as a QR Code posted in plain view around the facility. The new requirements went into effect on August 1, 2022. Please update your posters immediately to guarantee that your municipality is in compliance with the law. Any poster printed from the Division's website should be printed no smaller than letter size paper (8 ½ by 11 inches) and contain text that is fully legible and large enough to be easily read.
