NJDEP Reassigning All Tier B Municipalities to Tier A Municipalities Under MS4 Permit Program

The League has become aware that the New Jersey Department of Environmental Protection (NJDEP) has sent notification to municipalities regarding reassignment from Tier B to Tier A designation under the Municipal Separate Storm Sewer System (MS4) permit program. The NJDEP is moving to reassign all 101 municipalities currently designated Tier B to the Tier A designation. Detailed justification for the reassignment is provided by the NJDEP within the notification sent to individual municipalities, but the general reasoning provided is the need for additional protections from pollutants discharged into impaired waterways.

New Jersey Bans Single-Use Plastic Products to Begin May 4

Starting on Wednesday, May 4, New Jersey will implement the Single-Use Plastic Reduction Law (P.L 2020, C.117), which bans single-use plastic bags, straws, and polystyrene foam foodservice products. The law states that New Jersey businesses are banned from providing or selling single-use plastic products, except for providing a plastic straw upon request to comply with federal ADA regulations.
