Governor Murphy Signs Affordable Housing Bill into Law

Affordable Housing Posted on September 17, 2025

On September 11, Governor Murphy signed S-2506/A-2390 into law requiring the Department of Community Affairs (DCA) and the New Jersey Economic Development Authority (EDA) to give priority consideration to municipalities in compliance with affordable housing obligations in awarding State grants and other financial assistance through the Main Street New Jersey Program, Neighborhood Preservation Program, or any other program administered by the DCA. This includes any program administered by the DCA or the EDA through which funds are provided to a municipality through a competitive process.

The law’s provisions would not apply to grants for financial assistance intended to help a municipality fulfill its affordable housing obligation. At a minimum, the DCA will consider the following in determining a municipality’s compliance in the first five years after a new round of affordable housing obligations begins: prior round builder’s remedy lawsuits, prior round fair share settlements, the percentage of fulfilled obligation, and any other factor deemed relevant by the department.
