[ARCHIVED] Senate Approves Legislation to Ban Constable Positions

On Monday, December 11, the New Jersey State Senate favorably advanced bill S-2341/A-5281, sponsored by Senator Johnson, which seeks to abolish the position of constable and update related legislation to remove the term constable from state statutes. Current salary agreements for constables will remain valid until they expire, but the responsibilities and powers of the position are terminated immediately. This legislative action is in response to the New Jersey State Commission of Investigation's December 2021 report, 'Abusing the Badge.' The report describes the constable role as obsolete and potentially harmful, recommending its removal to enhance public safety.

The League supports this legislation as it will better protect residents from potential misconduct and ensures that law enforcement remains under the purview of the police. The League appreciates Senator Johnson's collaboration in addressing initial concerns regarding the legislation.

S-2341/A-5281 now awaits Governor Murphy’s action.
