The New Jersey Department of Environmental Protection (NJDEP) has issued proposed new rules and amendments to the Air Pollution Control rules, related to the state’s Advanced Clean Cars II Program.
The primary component of this rulemaking is the incorporation by reference of California’s Advanced Clean Cars II regulation to increase the percentage of zero-emission vehicles (ZEV) sold in New Jersey. As a reminder California’s Advanced Clean Cars II regulation will require manufacturers of passenger cars and light-duty trucks to meet an annual ZEV requirement.
This rulemaking has other components that will clarify and update several subchapters related to motor vehicles including N.J.A.C. 7:27-14, Control and Prohibition of Air Pollution from Diesel-Powered Motor Vehicles, N.J.A.C. 7:27-15, Control and Prohibition of Air Pollution from Gasoline-Fueled Motor Vehicles, and N.J.A.C. 7:27-28A, Model Year 2027 or Later Heavy-Duty New Engine and Vehicle Standards and Requirements, N.J.A.C. 7:27-29, Low Emission Vehicle (LEV) Program, and N.J.A.C. 7:27-31, Advanced Clean Trucks Program.
Additionally, the proposed rulemaking includes penalty provisions at N.J.A.C. 7:27A for the proposed new rules to the Air Pollution Control rules.
A public hearing on the proposal is scheduled to be conducted virtually on September 21 at 9:30 a.m. Written comments on the proposal are due by October 20. If you submit written comments, please forward a copy to the League’s Associate General Counsel Frank Marshall at fmarshall@njlm.org.
