New Definition for Custom Fabrication Under Prevailing Wage Act

Acting Governor Nicholas Scutari signed into S-3776, which amends the definition of “custom fabrication” under the Prevailing Wage Act. 

The definition was amended to include “other fabrication which is one or more entire modules or structure prefabricated to specifications for particular project of public work with minimal construction work remaining other than installations, regardless of whether unforeseen construction work is required on the public work site to modify the custom fabricated item for the purpose of installation, for use in a project of public work or for use in a type or classification of a project of public work.” Custom fabrication does not include components or materials, such as structural steel members or precast concrete, or smaller prefabricated components. 

P.L. 2023, c. 133 took effect on August 7, 2023, and is retroactive to the effective date of P.L. 2019, c. 44, which was March 18, 2019.
