NJDEP Releases Draft MS4 Model Ordinances

The New Jersey Department of Environmental Protection (NJDEP) has released two draft model ordinances related to the new conditions as part of the updated MS4 Tier A permit and will be accepting informal comments until May 12.   

The first draft model ordinance pertains to tree removal and replacement, and the second deals with privately owned salt storage. The NJDEP’s recent action to designate all municipalities as Tier A means these draft ordinances will be of interest to all members. Additional information regarding the MS4 program and the draft ordinances can be found on the NJDEP website.  

Comments on the drafts should be submitted to the NJDEP on or before May 12 via email to stormwatermanager@dep.nj.gov. Should you submit comments, the League is asking that you kindly forward a copy League Associate General Counsel, Frank Marshall at FMarshall@njlm.org.
