As we have previously reported, the New Jersey Department of Environmental Protection (NJDEP) introduced sweeping changes to land use regulations through the Resilient Environments and Landscapes (REAL) Rule proposal. The more than 1,000-page proposal will significantly impact municipalities across the state. Comments on the proposal were due November 7.
The League submitted comments to the NJDEP regarding this proposal, expressing concerns over the impact they will have on municipal governments and taxpayers. Other stakeholders, including individual municipalities and counties, have also submitted comments expressing concerns regarding the sweeping changes.
The NJDEP has indicated that final rules will be adopted in the summer of 2025.
